  公訴實(shí)踐中,公訴人員應(yīng)當(dāng)樹立理勝公訴的執(zhí)法理念。因?yàn)樽C據(jù)是司法之源,從立案開始,偵查人員就要面對證據(jù),公訴人員審查起訴的整個(gè)階段更是圍繞證據(jù)展開,庭審中控辯焦點(diǎn)也往往是證據(jù)的爭辯。我國刑事訴訟法規(guī)定的提起公訴的證據(jù)標(biāo)準(zhǔn)是“證據(jù)確實(shí)、充分”,但對于如何界定證據(jù)充分沒有更具體的細(xì)則,所以實(shí)踐中公訴人員經(jīng)常就此產(chǎn)生分歧爭議。所以,實(shí)踐中,有的公訴人員以案件缺少什么證據(jù),什么證據(jù)沒有調(diào)取到為由對案件提出存疑不起訴,有的公訴人員在對案件已經(jīng)形成內(nèi)心確信的情況下,為了使指控犯罪的證據(jù)體系更加牢固,列出還可能收集到的有罪證據(jù),退回偵查機(jī)關(guān)補(bǔ)充偵查,以求偵查機(jī)關(guān)窮盡所有可能收集到的有罪證據(jù)。
